Garden Leave

An employer can require an employee to stay at home during their notice period (garden leave). The employee remains employed with full pay and benefits, but must not attend work, contact clients, or start new employment until the notice period ends.

PILON Tax Treatment

Since April 2018, all payments in lieu of notice (PILON) are subject to Income Tax and National Insurance, whether or not there is a PILON clause in the contract. This includes both contractual and non-contractual PILON payments.

Rights During Notice Period

During the notice period the employee retains all contractual and statutory rights, including entitlement to sick pay, pension contributions, and all other workplace benefits. The employer cannot reduce pay or benefits during the notice period.
